1. Introduction

Welcome to GuardBhaiya.

GuardBhaiya operates an online technology platform that enables customers to discover, connect with, and engage independent security service providers, including individual professionals, agencies, event security personnel, bouncers, and personal security officers ("Service Providers").

GuardBhaiya is a technology platform and does not itself provide security services.

By accessing or using the Platform, you agree to be bound by these Terms & Conditions.

2. Marketplace Nature of Services

GuardBhaiya acts solely as a technology intermediary.

GuardBhaiya does not:

Employ Service Providers;
Operate as the direct employer of Service Providers;
Supervise on-site security operations;
Control how services are performed;
Guarantee the conduct, performance, suitability, licensing, training, or qualifications of any Service Provider.

Any engagement for security services is entered into directly between the Customer and the selected Service Provider.

3. Independent Service Providers

All Service Providers available through the Platform are independent third parties.

Nothing contained in these Terms shall create:

Employer-employee relationships;
Partnership relationships;
Joint ventures;
Agency relationships;
Franchise relationships;

between GuardBhaiya and any Service Provider.

Service Providers remain solely responsible for their own conduct, performance, actions, omissions, taxes, licenses, registrations, permits, insurance obligations, and legal compliance.

4. Customer Responsibility

Customers are responsible for:

Verifying the suitability of a Service Provider for their requirements;
Communicating service expectations;
Ensuring the legality of requested assignments;
Obtaining any permissions required by law.

Customers shall not request any illegal, unlawful, dangerous, or prohibited activity.

5. No Warranty

The Platform is provided on an "as available" and "as is" basis.

GuardBhaiya makes no representations or warranties regarding:

Service quality;
Provider availability;
Provider qualifications;
Provider conduct;
Continuous operation of the Platform;
Specific outcomes from any engagement.

6. Limitation of Liability

To the maximum extent permitted by law, GuardBhaiya shall not be liable for:

Theft;
Property damage;
Personal injury;
Death;
Misconduct;
Assault;
Negligence;
Criminal acts;
Unauthorized acts;
Failure to perform services;

committed by any Service Provider or third party.

Customers acknowledge that GuardBhaiya is not responsible for the actions, omissions, decisions, or conduct of independent Service Providers.

7. Disputes Between Users

Any dispute arising between a Customer and a Service Provider shall be resolved directly between those parties.

GuardBhaiya may, at its discretion, assist in communication but is not obligated to investigate, mediate, arbitrate, or resolve disputes.

8. Payments

GuardBhaiya may facilitate collection and processing of payments through the Platform.

Collection of payment by GuardBhaiya does not create an employment relationship, agency relationship, or service-provider relationship between GuardBhaiya and any Service Provider.

GuardBhaiya may deduct platform fees, commissions, taxes, processing fees, or other applicable charges before remitting payments.

9. User Conduct

Users shall not:

Violate any applicable law;
Provide false information;
Misuse the Platform;
Engage in fraudulent activities;
Use the Platform for unlawful purposes.

GuardBhaiya reserves the right to suspend or terminate accounts at its sole discretion.

10. Indemnification

Users agree to defend, indemnify, and hold harmless GuardBhaiya, its directors, officers, employees, affiliates, and representatives from any claims, liabilities, losses, damages, costs, expenses, or legal fees arising from:

Use of the Platform;
Violation of these Terms;
Interactions between Customers and Service Providers;
Breach of applicable laws.

11. Intellectual Property

All trademarks, logos, branding, software, content, and intellectual property associated with GuardBhaiya remain the exclusive property of GuardBhaiya.

No user may copy, distribute, reproduce, or exploit such content without prior written permission.

12. Account Suspension

GuardBhaiya may suspend, restrict, or terminate access to the Platform at any time for violations of these Terms or for operational, security, legal, or business reasons.
